Terms and conditions
The online shop www.vladila.com contains any kind of information (texts, pictures, databases, products, prices, logos, advertisements), which constitute the content of the online shop www.vladila.ro, property of the company S.C AESTHETIC INDESIGN SRL. Any use of the content (in whole or in part) for purposes other than personal interest is sanctioned by the legislation on intellectual property rights.
The information provided on this site is in Romanian. The sales contract is concluded in Romanian.
Your access and/or use of the site constitutes your ACCEPTANCE of these terms and conditions and binds you to abide by them.
Any information concerning the contract concluded between you and S.C AESTHETIC INDESIGN SRL will be stored for a limited time and will be available to third parties only at the request of the judicial authorities.
Any confirmed order involves the seller and the consumer – natural person in a distance contract.
The distance contract is concluded between S.C AESTHETIC INDESIGN SRL, as seller and a buyer, within the framework of this sales system organized by S.C AESTHETIC INDESIGN SRL, using exclusively, before and at the conclusion of this contract, the distance communication technique contained in the online shop;
The moment of the conclusion of the distance contract with the natural person, respectively, of the conclusion of the sales contract with the legal person, is the moment of receipt of the confirmation message by the consumer, regarding his order.
In case of any error in the transmission of the data necessary for the processing of your order, you have at your disposal the e-mail address office@vladila.com.
Subsequent to the processing of the order by S.C AESTHETIC INDESIGN SRL, we do not assume any liability arising from the transmission of erroneous data by you.
With regard to the relevant codes of conduct, according to art. 8 letter e) of Law no. 365/2002 on electronic commerce, Law 363/2007 on combating unfair practices, please consult the specific legislation posted on the ANPC website, section “Regulatory Acts”.
The provisions of this distance contract are also supplemented by Law 365/2002 on electronic commerce republished and amended and GEO 34/2014 on consumer rights in contracts concluded with professionals.
Definitions of this document:
S.C AESTHETIC INDESIGN SRL accepts the conclusion of distance contracts by electronic means and thus undertakes to comply with the legislation applicable to the conclusion, validity and legal effects of these contracts. Throughout this document, the following capitalized terms shall have, unless the context indicates otherwise, the meanings specified below:
USER: any person who visits and/or interacts with the S.C AESTHETIC INDESIGN SRL website;
SELLER: AESTHETIC INDESIGN S.R.L., a privately owned company, registered at the Trade Register with No. J15/58/2018, tax code 38697577 and registered office in Str. Ciprian Porumbescu 7, Targoviste, Dambovita, hereinafter referred to as “the Operator” or “AESTHETIC INDESIGN”.
BUYER: Any natural or legal person who places an order in the online shop www.vladila.ro and who has accepted the terms and conditions of this contract at a distance.
ONLINE STORE: web pages belonging to S.C AESTHETIC INDESIGN SRL located at www.vladila.ro, through which the buyer has access to information on products offered for sale by S.C AESTHETIC INDESIGN SRL. In the online store S.C AESTHETIC INDESIGN SRL are made available to buyers for sale products from the physical store S.C AESTHETIC INDESIGN SRL located in Bucharest, Ciobanasului Street No 20.
GOODS: products made available to the buyer for sale by the seller through the online store S.C AESTHETIC INDESIGN SRL.
ONLINE ORDER: online communication between seller and buyer, whereby the buyer intends to purchase goods from the seller, which the seller agrees to deliver and the buyer agrees to pay for.
CONFIRMED ORDER: an order placed online via the online shop www.vladila.com by a buyer whose identification data and details of his order have been validated by telephone following contact between him and the AESTHETIC INDESIGN customer support operator.
NEW CUSTOMER: customer who intends to purchase products from the AESTHETIC INDESIGN online shop for the first time and who requires a telephone validation of the order by the customer support operator designated by AESTHETIC INDESIGN.
Hours of operation:
Orders can be placed online at any time, but the order processing period is daily from 09:00-18:00.
Orders placed on Saturdays, Sundays and public holidays will be processed on the next working day.
If the customer is new, the seller assumes acceptance of the order from the buyer when there is a confirmation by phone or e-mail.
Once the online order has been placed, the buyer agrees to the form of further communication (telephone or e-mail) as well as to the seller’s mode of operation.
Obligations of the seller:
The seller shall provide the buyer, free of charge, with professional information on its products and services in order to achieve the purpose stated in the online order. The content published in the AESTHETIC INDESIGN online shop is indicative and presents information about the products sold by it, as well as other data considered by AESTHETIC INDESIGN as being of interest to the BUYER.
AESTHETIC INDESIGN is the owner of all intellectual property rights on the online shop, namely on the collections, design, site functionalities, images and technical specifications.
The characteristics of the products and related technical documentation presented on the site are made available by AESTHETIC INDESIGN and provides technical support for their display.
The seller constantly endeavours to present the most accurate and relevant information for the products offered for sale. If prices or other product information have been incorrectly displayed, we reserve the right not to honour the order and to notify the customer of the error if delivery has not taken place.
Product images are displayed in the online shop for presentation purposes only. The products actually ordered may differ in some characteristics (e.g. colour shades) from the actual appearance of the product, depending on the batch in which they were manufactured.
In order to carry out the distance contract in good conditions, AESTHETIC INDESIGN, based on the agreement expressed by the customer, may contact the customer by e-mail or telephone, if after interacting with the site the customer fills in the identification and contact data. The purpose for which the customer will be contacted is to expressly request any information for the successful completion of the online ordering process.
The price of the ordered product is the one displayed at the time of placing the order.
Promotions are valid:
– for limited periods of time, specified on the product presentation page of the online shop;
– within the limits of available stocks. Products, prices and stock availability information displayed. AESTHETIC INDESIGN cannot be held responsible for any damage created by information published in the online shop due to errors not of its making.
AESTHETIC INDESIGN reserves the right to supplement and/or change any information in the online shop without prior notice to the users of the website.
Communication with the AESTHETIC INDESIGN online shop is done at the time of interaction, by publishing opinions on AESTHETIC INDESIGN products and services, through the contact form available, via the e-mail address office@vladila.com. AESTHETIC INDESIGN reserves the right to contact the visitor of the online shop by e-mail or telephone if, following the interaction with the website, he/she fills in the identification and contact data and expressly requests any available information.
Ordering process
The customer can launch an online order from the product listing page or the individual product page and complete the order after selecting a payment and delivery method.
Products added to the shopping cart do not entail the registration of the order or the reservation of the goods added to the shopping cart in the shop.
For the successful completion of the order process the customer assumes that all contact details provided by the customer are complete and correct. If necessary, for the successful completion of the order the buyer may be contacted by the seller by available means agreed by the seller with the provision of contact details.
For an online order with delivery by courier, customers will be contacted by AESTHETIC INDESIGN Customer Support for telephone confirmation of the order.
The seller reserves the right to cancel the order placed by the buyer in one of the following cases:
– If the payment has not been accepted by the payment processor approved by AESTHETIC INDESIGN – the data provided by the customer is incorrect/incomplete;
– The card/transaction is not accepted by the issuing bank;
– Payment made by PO (bank transfer/internet banking), not made within 3 working days;
– Delivery by courier / AESTHETIC INDESIGN means of transport was not possible (ex. The customer cannot be reached by the courier by phone and/or physically at the address indicated for delivery of the purchased goods, etc.);
– If the price of the product is unreasonable (as defined in Art. 1665 of the Civil Code)
In case of cancellation of the order, neither of the parties involved will claim/claim damages.
In order to optimize the online ordering service, AESTHETIC INDESIGN reserves the right to restrict the customer’s access to certain features of the online shop, such as the impossibility to complete an online order if the customer has not created a user account.
In the case of orders paid electronically, the Seller cannot be held responsible for any other costs incurred by the Buyer, such as transaction fees, currency conversion fees (if payment is not made in lei) applied by the bank issuing the card. The Buyer is solely responsible for this action. The entire responsibility lies with the Customer and any disputes will be settled between the Customer and the bank issuing the card.
Intellectual property rights
The content of the AESTHETIC INDESIGN website including, but not limited to, graphics, names, trademarks (such as, for example: the name of the website and of the AESTHETIC INDESIGN company, symbols, images, texts, multimedia files) are the property of AESTHETIC INDESIGN SRL and may not be taken and/or used without the prior written consent of the owner.
Visitors to this site may copy information from this site for personal, non-commercial use only and without deletion or modification. Modification or use of materials on this site for purposes other than informational purposes, i.e. use as a customer, is strictly prohibited.
By accessing this site, visitors agree that any names, logos, trademarks or service marks, texts, documents and media files displayed on this site are owned by Aesthetic Indesign and may not be used by the user except for informational purposes. AESTHETIC INDESIGN will take legal action if intellectual property rights and copyrights are infringed.
If AESTHETIC INDESIGN grants the Visitor/Customer the right to use the content of the website in a certain way, the Visitor/Customer will use it only for the purpose for which it was defined and for a period defined in the agreement.
Any unauthorized modification of the site is prohibited.
Limitation of liability
By accessing the site you agree that use is at your own risk. AESTHETIC INDESIGN is not responsible for any direct or indirect incident or any other losses, costs or expenses of any nature whatsoever that may occur as a result of accessing or browsing the site or through downloads of data (text, images, video or audio).
Furthermore, AESTHETIC INDESIGN is not responsible for any damage caused by viruses, bugs, human actions or any failure of the computer system or any other errors, failures or communication delays in transmissions on devices.
All information and materials contained on this site are provided free of charge, without any warranty of any kind. Under no circumstances shall AESTHETIC INDESIGN be liable for any direct, indirect, incidental, special or consequential damages arising out of the use or inability to use this site and shall not be liable for any damages whatsoever resulting from errors, omissions, interruptions, mistakes, defects, delays in operation or transmission or any failure of performance of the site.
With the creation and use of the customer account, the user is responsible for maintaining the confidentiality of the login data. The user will keep the confidentiality of the user and password and will use it responsibly for the management of orders and facilities provided in the customer account.
Users agree not to share or transfer passwords or any other access information to any other third party. Users assume sole responsibility for account use and password confidentiality.
By accessing the site, creating a user account and placing orders the customer expressly and unequivocally accepts the Terms and Conditions of the site and the conditions under which the online ordering process is carried out, as presented on the site.
Aesthetic Indesign cannot be held liable for damages resulting from the loss of the purchased Goods or from the use of the Goods after delivery, except for the legal and conventional guarantees granted.
Aesthetic Indesign reserves the right to modify at any time the terms and conditions of the website and the general conditions under which the online ordering process takes place. The customer confirms that he accepts these terms and conditions by ticking the “I agree to the terms and conditions” checkbox. The remote contract concluded is carried out under the terms and conditions valid at the date of the agreement of wills.
Using the site
In certain areas of the site visitors may submit text, files, images, pictures, video files, audio files or other user-generated material. Aesthetic Indesign reserves the right to remove any user-generated content that does not comply with the terms below. In this regard, users agree to abide by the following:
– not to submit content that is unlawful, defamatory, libelous, defamatory, obscene, threatening, harassing, abusive, racist or infringing of intellectual property rights or other material that could constitute or encourage conduct that would be considered a criminal offense;
– not to send any personal information or violate the privacy of any other individual in any way, including by sending their personal data; not to upload software to the site, links or files that contain viruses, corrupted files or any other similar software or programs that may adversely affect the operation of the site or elements of the site; not to modify in any way the source code of the site or other technologies or applications incorporated into the site, unless expressly authorized in writing by Aesthetic Indesign.
Terms and conditions for posting product reviews
These guidelines are intended to make transparent the objectives of the section and the rules for posting opinions on www.vladila.com. Thus, the REVIEWS section has been introduced to give customers the opportunity to share their experience with products with each other. Your opinions are also carefully analysed by AESTHETIC INDESIGN employees who use them as a guide in choosing the products and range offered to customers.
By publishing user-generated content on the AESTHETIC INDESIGN website, you grant us a non-exclusive, perpetual, irrevocable, territorially unlimited license without obligating the company to make any payment to the user/customer or any third party.
This license includes the right to host, reproduce, modify, adapt and distribute any user content published on the AESTHETIC INDESIGN website. Recommendations, suggestions and rules for publishing opinions on the AESTHETIC INDESIGN website:
– Opinions will be posted on the website within 3 working days from the date of their submission, if the recommendations and suggestions in this section are respected;
– When you consider that an opinion violates these recommendations, please let us know on office@vladila.com;
– Relevant and honest opinions about products will be published on the website;
– In expressing your opinions, please be as specific as possible (what you liked, what you didn’t like about the product);
– You can include in your comments suggestions for other customers, as a result of owning and using the product, which will help other customers to form an opinion about the product;
– In expressing your opinions, please refer to the features and use of the product and not to other aspects (e.g. delivery, offers, prices, etc.).
– The information submitted is realistic, not misleading, written in accordance with the nature for which the product was created;
– Do not include your contact details (or confidential information about other people) in the body of the comment. These should be filled in the reserved fields (e.g. name, surname, e-mail, telephone). Please do not use false contact details or contact details that do not belong to you;
– We reserve the right not to publish opinions that contain offensive or defamatory language, criticism of other customers who have posted previous messages;
– We reserve the right not to publish on the site opinions or questions about stock and product availability, price, delivery and other details. For such requests please use the contact form;
– We reserve the right not to publish messages referring to other companies’ products and offers, contact persons or any link to them (website address, e-mail address, contact details, physical address, etc);
– We reserve the right not to publish opinions that are intentionally misleading, malicious, false or incomplete.
Publicity and privacy
The Buyer shall not disclose to third parties, by any means whatsoever, any information of a private nature received from the Seller, under penalty of the Seller being liable to pay damages.
The Seller reserves the right to use the information provided by the Buyer for the purpose of the remote performance of the contract. Furthermore, the Buyer shall not make public to any third party any information concerning the order without the written consent of the Seller.
The Seller reserves the right, on the basis of the user’s consent, to store and use for its own interest, for the purpose of carrying out marketing activities, any information provided by the buyer through the website www.vladila.ro. It will also not provide any third party with the information received from the buyer, except for its approved partners, service providers with whom there is a contract protecting the data received from the buyer.
Remarketing terms
On the pages of the website www.vladila.com, through the use of a remarketing tag and conversion code received from Google AdWords cookies are collected.
An internet cookie is a small file, consisting of letters and numbers, which will be stored on a user’s computer, mobile terminal or other equipment from which the internet is accessed. Cookies allow the website to provide personalised information to the user.
Cookies ensure the user a pleasant browsing experience and support Aesthetic Indesign’s efforts to deliver relevant advertisements based on user preferences.
Google remarketing tag collects cookies to display ads on Google Display network websites and in Google Search. When users visit a website page that contains a remarketing tag, the cookie of the browser they are using is added to a remarketing list.A remarketing list is a set of user cookies generated by one or more remarketing tags.
Google AdWords uses these cookies to display sponsored ads on Google Display network websites and in Google Search to users who have visited the www.vladila.com website pages.
If visitors to the Aesthetic Indesign website do not agree to Google’s use of cookies, they can disable the display of ads through the Ads Preferences Manager. Our partners will not collect personal information such as name, email address, postal address or phone number. If visitors to the Aesthetic Indesign website do not agree to the use of cookies by our advertising partners, they can disable the display of ads by using the website here.
Invoicing and issuing documents accompanying the parcel
The seller will issue an invoice for the delivered goods on the basis of the information held by the seller and provided by the buyer. The parcel/goods will also be accompanied by the documentation sent by the supplier and required by law for the product(s) ordered, as appropriate: certificate/statement of conformity, warranty certificate, instructions for use, etc.
The prices of the products displayed on the website www.vladila.com include VAT according to the legislation in force.
The customer is obliged to provide complete and correct data, necessary to issue the invoice according to the legislation in force. In this regard, Aesthetic Indesign will not ask the customer, through the forms present on the site, other information of a confidential nature other than those necessary for the issuance of the invoice, delivery of products or the successful completion of the online ordering process.
Aesthetic Indesign will send the customer the invoice related to the order, both in electronic format, available online in the “Customer Account” and in physical format, once the Goods are delivered. Thus, the customer has the possibility to have a record of the invoices issued.
In order to successfully complete the online ordering process, the customer is obliged to update the personal information in his account.
If the invoice is not available in the customer’s account, within 48 hours after receipt of the goods, the customer is requested to send a complaint to office@vladila.com.
Risks and responsibilities
The seller is responsible for the proper packaging of the goods. The technical documentation relating to the products is displayed on the website.
The risk of loss of the goods is transferred to the buyer when the goods are actually delivered.
The seller assumes responsibility for the delivery of the products ordered by the buyer.
Delivery and acceptance of goods
The Seller undertakes to deliver the goods via Aesthetic Indesign’s approved courier companies or means of transport to the Buyer.
The delivery of the goods is international.
The Buyer has the right not to accept the delivered goods if they do not comply with the technical details specified on the product page. In this case, the Seller assumes the responsibility for bringing the goods into conformity.
The Buyer will take possession of the goods after signing the transport document and making the payment (if this has not been previously made by card or bank transfer) to the courier or Aesthetic Indesign staff.
Force majeure
Force majeure (unforeseeable, uncontrollable and unavoidable event affecting the performance of the contract) exempts the party invoking it from liability.
Disputes. Applicable law
Contractual relations between the parties are governed by Romanian law. Any dispute that cannot be resolved amicably will be referred to the competent courts for resolution.
